APImage

Refers to the company and service provider of APImage, including all its subsidiaries, affiliates, agents, and authorized representatives, responsible for providing image processing and AI features via web interface and API.

User

Any individual or legal entity who accesses, registers for, or otherwise uses the Service, including authorized agents and employees acting on behalf of an entity.

Service

APImage Platform

Collectively refers to the APImage website, web application, API, and all related tools, features, and services offered by APImage, including but not limited to image processing, AI features, and any associated software or documentation.

Credits

AI Processing Units

Virtual units that represent the computational resources required to perform operations within the Service. Credits are consumed based on the complexity and quantity of operations performed, as detailed in the pricing and credit consumption documentation.

These definitions apply throughout these Terms and any related documents unless otherwise specified.

Base Model Image

Standard Output

An image output generated by APImage's standard AI model without premium enhancements or additional stylistic processing.

Premium Image

Enhanced Output

Image outputs generated using advanced, high-resolution, or stylistic AI models that typically consume more AI Credits due to increased computational complexity or quality levels.

Background Removal

AI Feature

A specialized AI-powered feature that automatically detects and removes the background from uploaded images, delivering transparent or altered-background results.

Image-to-Text Analysis

AI Processing

Includes any AI-based processing related to extracting or generating descriptive textual content from images, such as optical character recognition (OCR), caption generation, or semantic image analysis.

LemonSqueezy

Payment Processor

The third-party billing and payment processor acting as the Merchant of Record (MoR) for APImage's financial transactions, responsible for handling payments, invoicing, tax compliance, and refunds.

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Important: These Terms constitute a legally binding agreement between you and APImage. Please read them carefully before using the Service.

Agreement to Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Updates to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

Minimum Age

The Service is not intended for users under the age of 16. By using the Service, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the Service or provide any information to us.

Jurisdiction and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Germany.

By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving the Service.

AI Credits and Consumption

Credit System

APImage operates on a credit-based system where different operations consume varying numbers of credits based on computational resources required. Credits are the virtual currency used to access and utilize our AI image processing services.

Credit Consumption

• Credits are consumed per operation based on complexity
• Higher resolution or more complex operations consume more credits
• Credit costs are stated on the pricing page.

Credit Balance

• Credits are deducted from your balance upon operation completion
• Check your remaining credits in your account dashboard
• Credits included in a subscription are valid only for the current billing cycle and do not roll over. Unused credits will expire at the end of each cycle (e.g., monthly).
• Individually purchased credits expire 12 months from the date of purchase or upon account deletion, whichever occurs first. All credit purchases are non-refundable.

Important Notes

Credits are consumed immediately when processing begins and cannot be refunded once processing starts, even if the operation is canceled or fails.

Subscription Plans and Billing

Subscription Terms

By subscribing to our Service, you agree to the following terms:

All subscription fees are billed in advance and are non-refundable except as required by law.

You must provide accurate and complete billing information including full name, address, and valid payment method.
Automatic Renewals
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
Account Responsibility
You are responsible for all charges incurred under your account, including applicable taxes and fees.

Monthly Billing

Charged on the same date each month based on when you started your subscription.

Annual Billing

Minimum contract duration is one year, charged either annually or monthly.

Enterprise

Failed payments may result in service suspension after a grace period.

Tax Responsibility

Tax Obligations

Each party is responsible for their own tax obligations related to the use of our Service:

User Responsibility

• Users are solely responsible for determining what taxes apply to their use of the Service
• Users must comply with all applicable tax laws and regulations in their jurisdiction
• Users are responsible for reporting and remitting any taxes to the appropriate tax authorities

Our Responsibility

• We will collect and remit sales tax where required by law
• Tax rates are calculated based on the information you provide and the location where our services are performed
• Tax invoices will be provided for all transactions where applicable

Important Tax Information

Tax rates are subject to change based on updates to tax laws and regulations in your jurisdiction.

For tax-exempt organizations, please provide valid tax exemption documentation to ask@support.apimage.org.

Taxes, where applicable, will be calculated and added during the checkout process.

International users may be subject to additional taxes, duties, or fees imposed by their local authorities.

By completing your payment, you confirm that you are acting as a business customer (entrepreneur as defined in § 14 of the German Civil Code – BGB). All pricing on our website is intended exclusively for business-to-business (B2B) transactions.

Refund Policy

• Within 14 days of initial monthly subscription
• Within 14 days of annual subscription
• For the most recent payment only

• After the refund period has ended
• For partially used subscription periods (e.g., credits consumed)
• For any promotional or discounted periods

Processing Time

Refund requests are typically processed within 5-7 business days.

The refund will be credited to your original payment method.

Your financial institution may take additional time to post the credit to your account.

Image processing is carried out on our servers and on the servers of our authorized subprocessors. Upon completion, processed images are stored on our servers.

You retain all rights to your original and processed images.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make the Service available are free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APIMAGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless APImage and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

Your use of and access to the Service
Your violation of any term of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right

Note: Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Credit Rollover Policy

Credit Expiration Policy

Subscription Credits

Credits included with your monthly or annual subscription are valid only for the current billing period and do not roll over to the next period.

Monthly credits expire at the end of each billing cycle

Annual credits expire at the end of the annual subscription period

Purchased Credits

Additional credits purchased separately from a subscription have the following expiration terms:

Expire 12 months from the date of purchase

Non-refundable and non-transferable

Promotional Credits

Credits received through promotions, giveaways, or special offers may have different expiration terms as specified at the time of the offer.

May expire sooner than purchased credits

Copyright and Impersonation

APImage respects intellectual property rights and expects users to do the same. When using our service, you must comply with all applicable copyright laws.

Prohibited Actions:

Uploading, processing, or generating content that infringes on any copyright, trademark, or other intellectual property rights
Using the service to create derivative works without proper authorization from the copyright holder
Removing or altering any copyright, trademark, or other proprietary notices from any content

Impersonation Policy

APImage strictly prohibits any form of impersonation or misrepresentation of identity. This includes but is not limited to:

Identity Misrepresentation

Creating accounts or content that falsely represents you as another person, company, or entity

Fake Accounts

Registering accounts under false pretenses or using false information

Misleading Communication

Sending communications that appear to be from someone else

Deceptive Practices

Any other activity intended to deceive or mislead others about your identity

Consequences: Violations of this policy may result in immediate account suspension or termination, and we reserve the right to report such activities to the appropriate authorities.

APImage strictly prohibits the upload, generation, or sharing of any content that is illegal, harmful, or otherwise objectionable. This includes, but is not limited to:

Harmful or Dangerous

Content that promotes violence, self-harm, or harm to others

Hate Speech

Content that promotes hatred or violence against individuals or groups

Adult Content

Sexually explicit or pornographic material

Harassment

Content intended to harass, threaten, or bully others

Deceptive Practices

Misinformation, scams, or deceptive content

AI Moderation

To maintain a safe and legal platform, APImage employs automated systems to analyze and moderate content. This includes:

Automated Scanning

All uploads and generations are automatically scanned for policy violations

Content Analysis

AI systems analyze both text prompts and generated images for compliance

Human Review

Suspected violations may be reviewed by our moderation team

Reporting System

Users can report content that may violate our policies

Note: While we use automated systems to detect policy violations, no system is perfect. We appreciate user reports of any content that may have been missed.

Consequences of Violations: Violations of this policy may result in immediate account suspension or termination, removal of content, and reporting to the appropriate authorities when required by law.
