By accessing or using APImage ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

APImage provides AI-powered image generation, inpainting, background removal, and related image processing tools accessible through our web application and API. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with notice.

When you create an account, you must provide accurate and complete information. You are responsible for: - Maintaining the security of your account credentials - All activities that occur under your account - Notifying us immediately of any unauthorized use We reserve the right to suspend or terminate accounts that violate these terms.

You agree not to use the Service to: - Generate illegal, harmful, or exploitative content - Create deepfakes or misleading media intended to deceive - Infringe on intellectual property rights - Generate content that violates any applicable laws - Attempt to reverse-engineer or exploit our AI models - Exceed rate limits or abuse API access - Resell access without authorization We reserve the right to review and remove content that violates these policies.

**Your Content:** You retain ownership of images you upload. You grant us a limited license to process your images for the purpose of providing the Service. **Generated Content:** Images generated using APImage are licensed to you for commercial and personal use, subject to plan-specific terms. You may not claim exclusive ownership of AI-generated output. **Our Service:** The APImage platform, including its design, logo, and underlying technology, is owned by APImage GmbH and protected by intellectual property laws.

Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method. - Prices are subject to change with 30 days' notice - Refunds are available within 30 days of purchase - Failed payments may result in service suspension - Unused credits do not carry over between billing periods

To the maximum extent permitted by law, APImage shall not be liable for: - Indirect, incidental, or consequential damages - Loss of data, profits, or business opportunities - Service interruptions or downtime - Content generated by the AI models Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless APImage, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

We may terminate or suspend your account at any time for violation of these terms. Upon termination: - Your right to use the Service will cease immediately - We may delete your account data after 30 days - Provisions that should survive termination will remain in effect

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Berlin, Germany.
