Terms of Service

In these Terms of Service (“Terms”), the following definitions apply unless the context requires otherwise:

APImage / we, us, our
Refers to the company and service provider of APImage, including all its subsidiaries, affiliates, agents, and authorized representatives, responsible for providing image processing and AI features via web interface and API.

User / you, your
Any individual or legal entity who accesses, registers for, or otherwise uses the Service, including authorized agents and employees acting on behalf of an entity.

Service / APImage Platform
Collectively refers to the APImage website, web application, API, and all related tools, features, and services offered by APImage, including but not limited to image processing, AI features, and any associated software or documentation.

Credits / AI Processing Units
Virtual units that represent the computational resources required to perform operations within the Service. Credits are consumed based on the complexity and quantity of operations performed, as detailed in the pricing and credit consumption documentation.

These definitions apply throughout these Terms and any related documents unless otherwise specified.

Base Model Image / Standard Output
An image output generated by APImage’s standard AI model without premium enhancements or additional stylistic processing.

Premium Image / Enhanced Output
Image outputs generated using advanced, high-resolution, or stylistic AI models that typically consume more AI Credits due to increased computational complexity or quality levels.

Background Removal / AI Feature
A specialized AI-powered feature that automatically detects and removes the background from uploaded images, delivering transparent or altered-background results.

Image-to-Text Analysis / AI Processing
Includes any AI-based processing related to extracting or generating descriptive textual content from images, such as optical character recognition (OCR), caption generation, or semantic image analysis.

Lemon Squeezy / Payment Processor
Lemon Squeezy, LLC (United States), trading as Lemon Squeezy, the third-party billing and payment processor acting as the Merchant of Record (MoR) for APImage’s financial transactions, responsible for handling payments, invoicing, tax calculation and remittance, refunds, and affiliate commission tracking and payouts. Lemon Squeezy acts as APImage’s Merchant of Record with effect from September 21, 2026. For purchases made before that date, the Merchant of Record was Polar Software Inc. (“Polar”), and the terms in force at the time of that purchase continue to apply to it.

Acceptable Use Policy / AUP / Appendix A
The APImage Acceptable Use Policy, available at apimage.org/legal/acceptable-use, which sets out the permitted and prohibited uses of the Service, applicable usage limits, moderation practices, and enforcement measures. The AUP is Appendix A to these Terms and is incorporated into them by reference. A reference to these Terms includes a reference to the AUP.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Important: These Terms constitute a legally binding agreement between you and APImage. Please read them carefully before using the Service.

Agreement to Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Updates to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

Minimum Age
APImage is an adults-only service. The Service is not intended for and may not be used by anyone under the age of 18. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are under 18, you may not register for, access, or use the Service, or provide any information to us, including under the supervision or account of a parent, guardian, or employer. We may require age verification at any time and may suspend or terminate any account we reasonably believe belongs to a minor, deleting the associated personal data in accordance with our Privacy Policy.

Jurisdiction and Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Germany.

By continuing to use the Service, you acknowledge that you have read and agree to be bound by these Terms of Service.

APImage provides an AI-powered image processing service that allows users to enhance, modify, and transform images using advanced machine learning algorithms.

Uptime
We strive to maintain 99.9% uptime for the Service, with scheduled maintenance windows.

Enterprise-grade security with data encryption at rest and in transit.

Note: The Service is provided “as is” and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

Service Availability
We strive to maintain 99.9% uptime for the Service, but we do not guarantee uninterrupted, secure, or error-free operation. The Service may be temporarily unavailable for scheduled maintenance or due to unforeseen circumstances beyond our control.

Changes to the Service
We continuously improve and update the Service. We may add, modify, or remove features, functionality, or content at any time. We will make reasonable efforts to notify you of any material changes that may affect your use of the Service.

Third-Party Services
The Service may integrate with or provide links to third-party services or websites. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with such services are solely between you and the third party.

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to provide accurate information and maintain the security of your credentials.

Strong Passwords

Regularly monitor your account for any suspicious activity.

Important: You are responsible for all activities that occur under your account. Never share your account credentials with anyone else.

Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms or any applicable laws or regulations.

User Content
You retain all rights to any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving the Service.

Our Service provides API access for programmatic integration. By using our API, you agree to the following terms:

1. Comply with all rate limits and usage quotas
2. Not attempt to circumvent any access restrictions
3. Use API keys securely and keep them confidential
4. Not use the API in a way that could harm our service

Rate Limiting

Standard Limits
Basic, Pro, and Business plans allow up to 60 requests per minute.
Enterprise plans offer configurable rate limits upon request.

Best Practices
Implement exponential backoff for retries and cache responses when possible.

Prohibited Uses
You may not use the API to:

1. Violate any applicable laws or regulations
2. Infringe upon intellectual property rights
3. Transmit viruses or harmful code
4. Gain unauthorized access to systems
5. Overload or damage our infrastructure
6. Use for illegal or harmful purposes

Credit System
APImage operates on a credit-based system where different operations consume varying numbers of credits based on computational resources required. Credits are the virtual currency used to access and utilize our AI image processing services.

Credit Consumption

1. Credits are consumed per operation based on complexity
2. Higher resolution or more complex operations consume more credits
3. Credit costs are stated on the pricing page.

Credit Balance

1. Credits are deducted from your balance upon operation completion
2. Check your remaining credits in your account dashboard
3. Credits included in a subscription are valid only for the current billing cycle and do not roll over. Unused credits will expire at the end of each cycle (e.g., monthly).
4. Individually purchased credits expire 12 months from the date of purchase or upon account deletion, whichever occurs first. All credit purchases are non-refundable.

Important Notes
Credits are consumed immediately when processing begins and cannot be refunded once processing starts, even if the operation is canceled or fails.

Subscription Terms
By subscribing to our Service, you agree to the following terms:

Merchant of Record
All payments, invoicing, and tax calculations are processed by our authorized Merchant of Record, Lemon Squeezy, LLC. By completing a purchase, you enter into a commercial transaction with Lemon Squeezy as the reseller of APImage services, and your invoice will be issued by Lemon Squeezy, LLC.

Effective Date of the Change of Merchant of Record
Lemon Squeezy is APImage’s Merchant of Record for all purchases made on or after September 21, 2026. Purchases made before that date were processed by our previous Merchant of Record, Polar Software Inc. (“Polar”), and invoices for those transactions were issued by Polar. Subscriptions created through Polar before September 21, 2026 continue to renew under the payment provider in place at the time of the change until they are migrated, canceled, or expire; you will be notified before any migration of an active subscription. Refund, invoicing, and tax-documentation requests relating to a pre-September 21, 2026 purchase are handled through the Merchant of Record that processed it. Contact ask@support.apimage.org and we will route the request. This change of Merchant of Record does not alter the price, scope, or duration of any existing subscription.

Payment Terms
All subscription fees are billed in advance and are non-refundable except as required by law.

Billing Information
You must provide accurate and complete billing information including full name, address, and valid payment method.

Automatic Renewals
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.

Account Responsibility
You are responsible for all charges incurred under your account, including applicable taxes and fees.

Billing Cycles

Monthly Billing
Charged on the same date each month based on when you started your subscription.

Annual Billing
Minimum contract duration is one year, charged either annually or monthly.

Enterprise
Custom billing cycles available for enterprise customers.

Important Notes
Price changes will be communicated at least 30 days in advance.
Failed payments may result in service suspension after a grace period.
Contact support for any billing inquiries or issues.

Tax Obligations
Each party is responsible for their own tax obligations related to the use of our Service:

User Responsibility

1. Users are solely responsible for determining what taxes apply to their use of the Service
2. Users must comply with all applicable tax laws and regulations in their jurisdiction
3. Users are responsible for reporting and remitting any taxes to the appropriate tax authorities

Our Responsibility

1. Our Merchant of Record, Lemon Squeezy, LLC, calculates, collects, and remits applicable sales, use, and value-added taxes where required by law
2. Tax rates are calculated based on the information you provide and the location where our services are performed
3. Tax invoices are issued by our Merchant of Record for all transactions where applicable

Important Tax Information
Tax rates are subject to change based on updates to tax laws and regulations in your jurisdiction.
For tax-exempt organizations, please provide valid tax exemption documentation to ask@support.apimage.org.
Taxes, where applicable, will be calculated and added during the checkout process.
International users may be subject to additional taxes, duties, or fees imposed by their local authorities.
By completing your payment, you confirm that you are acting as a business customer (entrepreneur as defined in § 14 of the German Civil Code – BGB). All pricing on our website is intended exclusively for business-to-business (B2B) transactions.

Refund Policy
We want you to be completely satisfied with our Service. Here’s our refund policy:

Eligible for Refund

1. Within 14 days of initial monthly subscription
2. Within 14 days of annual subscription
3. For the most recent payment only

Not Eligible

1. After the refund period has ended
2. For partially used subscription periods (e.g., credits consumed)
3. For any promotional or discounted periods

Processing Time
Refund requests are typically processed within 5-7 business days.
The refund will be credited to your original payment method.
Your financial institution may take additional time to post the credit to your account.
Important: To request a refund, please contact our support team at ask@support.apimage.org with your account details and reason for the refund request.

Incorporation by Reference
Your use of the Service is governed by the APImage Acceptable Use Policy, which is attached to these Terms as Appendix A and forms a binding part of this agreement. The Acceptable Use Policy sets out in full what is permitted and prohibited on the platform, the usage limits that apply, how content is moderated, how violations are reported, and what enforcement measures we may take. You must read it before using the Service. A breach of the Acceptable Use Policy is a breach of these Terms.

Summary of Prohibited Activities
The following summary is provided for convenience only and does not limit or replace Appendix A. You agree not to use the Service to:

1. Illegal Activities: Violate any applicable laws, regulations, or third-party rights.
2. Harmful or Dangerous Content: Create or distribute content that incites or facilitates violence, terrorism, self-harm, or the production of weapons or other dangerous materials.
3. Hate Speech: Attack, degrade, or dehumanize individuals or groups on the basis of a protected characteristic, or promote hateful or extremist ideologies or symbols.
4. Adult Content: Generate pornographic or sexually explicit material, sexualize any real person, or produce non-consensual intimate imagery, including “nudify” or clothing-removal transformations.
5. Minors: Produce, upload, or seek any sexual, exploitative, or endangering content involving minors. This carries zero tolerance and results in immediate permanent termination and referral to law enforcement.
6. Harassment: Target, threaten, stalk, dox, humiliate, or bully any individual.
7. Deceptive Practices: Impersonate any person or organization, forge identity or official documents, create counterfeit goods or currency, or produce fraudulent, scam, or disinformation material.
8. Face Swap and Deepfakes: Face swap is forbidden without exception. You may not swap, transfer, graft, or substitute the face or facial identity of any person onto another body, image, or scene, regardless of consent, regardless of whether the face is real or synthetic, regardless of whether the person is you, and regardless of purpose. Deepfakes, likeness manipulation of real people, facial recognition, biometric identification, and face-database building are likewise prohibited outright. See §6 of Appendix A.
9. Intellectual Property: Infringe copyrights, trademarks, design rights, or other proprietary rights.
10. Privacy Violations: Process personal or biometric data of third parties without a valid legal basis and any required consent.
11. Malicious Content: Upload or transmit viruses, malware, or other harmful code.
12. Unauthorized Access: Attempt to gain unauthorized access to systems, accounts, models, or model weights.
13. Service Disruption: Interfere with, overload, or circumvent the limits, metering, or safety filters of the Service.

Important: Violation of the Acceptable Use Policy may result in immediate account suspension or termination without refund, forfeiture of remaining credits, and, where applicable, referral to the competent authorities.

Content Guidelines
You are solely responsible for all content you upload, process, or generate using the Service.
Ensure you have all necessary rights, licenses, and consents for any content you process, including the consent of every identifiable person depicted.
We reserve the right to block, remove, or quarantine any content that violates these guidelines.

Data Handling
Your privacy and data security are our top priorities. Here’s how we handle your data:

Image Processing
Image processing is carried out on our servers and on the servers of our authorized subprocessors. Upon completion, processed images are stored on our servers.

Secure Transmission
All data is encrypted in transit using industry-standard TLS 1.2+ protocols.

Your Ownership
You retain all rights to your original and processed images.

Privacy Compliance
We adhere to all applicable data protection regulations including GDPR and CCPA.

Termination by Us
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

1. Violation of Terms: Breach of any provision of these Terms or our policies.
2. Abusive Behavior: Engaging in fraudulent, abusive, or illegal activities.
3. Payment Issues: Failure to pay fees when due or fraudulent payment activity.
4. Legal Requirements: Required to do so by law or to comply with legal processes.

Effects of Termination
Upon termination, your right to use the Service will immediately cease.
All fees paid are non-refundable, except as required by law.
We may delete your account information and data in accordance with our Privacy Policy.

Changes to Terms

Our Right to Modify
We reserve the right to modify these terms at any time at our sole discretion. We’ll inform you about significant changes through the Service interface or via email to the address associated with your account.

Effective Date
Changes will be effective immediately upon posting the revised terms unless otherwise specified. We’ll indicate the date these terms were last revised at the bottom of this page.

Your Acceptance
Your continued use of the Service after the posting of changes constitutes your binding acceptance of such changes. If you disagree with the new terms, you must stop using the Service.

Notification Preference: Ensure your account email is up-to-date to receive important updates about changes to our terms of service.

Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make the Service available are free of viruses or other harmful components.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APIMAGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. Your access to or use of or inability to access or use the Service
2. Any conduct or content of any third party on the Service
3. Any content obtained from the Service
4. Unauthorized access, use, or alteration of your transmissions or content

Indemnification
You agree to defend, indemnify, and hold harmless APImage and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use of the Service, violation of Terms, or violation of third-party rights.

Credit Expiration Policy
Subscription Credits
Credits included with your monthly or annual subscription are valid only for the current billing period and do not roll over. Monthly credits expire at the end of each billing cycle. Annual credits expire at the end of the annual subscription period.

Purchased Credits
Additional credits purchased separately from a subscription expire 12 months from the date of purchase and are non-refundable and non-transferable.

Copyright Protection
APImage respects intellectual property rights and expects users to do the same. When using our service, you must comply with all applicable copyright laws.

Prohibited Actions:

1. Uploading, processing, or generating content that infringes on any copyright, trademark, or other intellectual property rights
2. Using the service to create derivative works without proper authorization from the copyright holder
3. Removing or altering any copyright, trademark, or other proprietary notices from any content

If you believe your copyright has been infringed, please contact us at ask@support.apimage.org with the required information as specified in our DMCA policy.

Impersonation Policy
APImage strictly prohibits any form of impersonation or misrepresentation of identity. This includes but is not limited to: Identity Misrepresentation, Fake Accounts, Misleading Communication, and Deceptive Practices.

Prohibited Content
APImage strictly prohibits the upload, generation, or sharing of any content that is illegal, harmful, or otherwise objectionable. This includes, but is not limited to: Illegal Activities, Harmful or Dangerous content, Hate Speech, Adult Content, content involving Minors, Harassment, Deceptive Practices, and face swap, likeness transfer, or deepfake content, which are forbidden without exception. The complete and binding list is set out in Appendix A – Acceptable Use Policy.

AI Moderation
To maintain a safe and legal platform, APImage employs automated systems to analyze and moderate content. This includes: Automated Scanning, Content Analysis, and Human Review.

How to Report Violations
If you encounter content that violates our policies, please report it immediately by contacting our moderation team at ask@support.apimage.org.

Appendix A – Acceptable Use Policy
Sets out the permitted and prohibited uses of the Service, the content categories that are forbidden, the rules on faces, likeness, and face swap, usage and rate limits, fair-use requirements, moderation practices, reporting channels, and enforcement measures.

Order of Precedence
In the event of a conflict between these Terms and an appendix, these Terms prevail, except that where an appendix imposes a stricter rule on permitted use, the stricter rule applies. A separately negotiated and signed enterprise agreement prevails over both.

Appendices may be amended under the process set out in §12. The current version of each appendix is the one published at the address above.
